MA Seal on Constable Badges

Thanks to Lyle R. Hasley, a Constable for Mashpee, our Network has learned that a Constable's badge should not bear the Sigil of the Commonwealth of Massachusetts unless he/she is in regular employment as a Constable. Furthermore, a Constable may not use the seal of the Commonwealth on any business advertisement, according to MGL.

The 'Process Server' page, which has a Constable badge as an image, will be edited shortly.

That is NOT true, it OK for Constables to have the state seal on there badges. They cannot use the seal for there letterheads or websites. But they can have the seal on there badges. In the past your comment was correct and even according to the state secretary office that is correct or I should say was correct until recently. There is now case law that says the opposite and it was decided not long ago and it took place in springfield court. You can thank a Sprignfield Constable for setting that in motion.

I'aam the Former Constable who posted about the state seal being ok to use on a constables badge. I personally know and was witness to the Constables trial who initiaed the case law. I dont know how the case law except to ask the Constable involved what the case docket # was. However you may try and look in the springfield dist court or superior (I forgot which one it was so long ago) the Constables last name was Avilles so it should be comm v.avilles.
Or maybe call the secretary of states office and ask them they should know,then again who knows with them if there not up to date on case law then wouldnt know.
